Lahore – In Pakistan, the tactics of getting ‘unilateral proceedings’ cancelled are often used to prolong cases within family courts. The Lahore High Court has curbed this trend and strengthened the principle of ‘conditional remand’.
The court clarified in its recent decision that if a defendant (father) challenges the decision made due to non-appearance in court, he will have to first pay the child’s dues, demonstrating “national dignity” and “moral responsibility”.
Justice Raheel Kamran rejected the petitioner’s objection that the appellate court did not have the authority to impose such a condition.
Legal experts are welcoming the decision as it will save children from having to go through the courts for years and endure hunger and thirst.
