Pakistan Tehreek-e-Insaf (PTI) has initiated legal action against the imposition of Governor’s Rule and Emergency in Khyber Pakhtunkhwa. The party says that this move of the federal government has raised important questions regarding the protection of provincial autonomy and the electoral mandate of the people.
President Asif Ali Zardari, Prime Minister Shehbaz Sharif and Khyber Pakhtunkhwa Governor Faisal Karim Kundi have been made parties in the petition filed in the Peshawar High Court. The petitioner has taken the stand that the imposition of Governor’s Rule and Emergency is unconstitutional and illegal.
The petition has requested the court to declare the relevant measures null and void and suspend the notification of the imposition of the governor’s Rule until the final decision of the case.
PTI Chairman Barrister Gohar Ali Khan has also opposed the move and said that the party will challenge the decision through constitutional and legal means. According to him, political differences and the security problems of the province should be resolved through constitutional mechanisms and political consultations.
The federal government has based the imposition of emergency in Khyber Pakhtunkhwa on the security situation and the growing threat of terrorism. On the other hand, the PTI calls these measures detrimental to its provincial authority and democratic mandate.
Now the important stage of the matter will be the court proceedings, where the constitutional points raised in the petition and the legal position regarding the government’s move can be reviewed. After an order or decision by the court, the constitutional and administrative situation of the matter will become clearer.
