Supreme Court Rejects Appeal of Mir Ali Madad Jattak in PB-45 Election Matter

ISLAMABAD: The Supreme Court of Pakistan has rejected Mir Ali Madad Jattak’s appeal concerning the Election Tribunal’s ruling on 15 polling stations in PB-45 Quetta. The court delivered a comprehensive 25-page ruling authored by Justice Aqeel Abbasi.

The Supreme Court, in its ruling, affirmed the jurisdiction of the Election Tribunal, indicating that according to the Election Act, the tribunal has the powers of a civil court and is empowered to document evidence in accordance with the Evidence Act for electoral disputes. The court underscored that the case’s circumstances could not be disregarded on trivial technicalities since the election excuse was submitted in accordance with the law.

The Supreme Court observed that there was unequivocal evidence of election result tampering by the polling personnel. It was shown that 4912 votes for Mir Ali Madad Jattak were included via Form 45, while the rival candidate Mir Muhammad Usman had just 1623 votes documented. The Election Tribunal determined that fraud occurred in the Form 45 paperwork of 15 voting locations. The Supreme Court affirmed the Election Tribunal’s verdict, thus validating the tribunal’s ruling’s integrity.
