FBR Sets Customs Appeal Rules and 90-Day Deadline for Certain Cases

ISLAMABAD: Importers will have a defined route to challenge customs classification decisions under amendments issued by the Federal Board of Revenue, which also introduce a shorter decision period for certain disputes.

The revised procedure distinguishes between goods assessed provisionally and other new classification cases. Disputes involving provisionally assessed goods will be subject to a 90-day decision period, while the general 120-day timeline will remain applicable to other fresh cases.

The changes were issued through Customs General Order No. 07 of 2026, amending the framework that governs the resolution of classification disputes.

The new provisions are scheduled to take effect on January 1, 2027.

The FBR has also established a formal appeal mechanism for parties dissatisfied with a classification decision. Under the amended procedure, an appeal must be submitted to the board within 30 days of the relevant public notice.

Customs classification determines how imported products are categorised under the tariff schedule. The classification can affect the duties and taxes payable, making disputes financially significant for importers and the government.

The dedicated Classification Centre examines referred cases, issues rulings and maintains classification-related information. Clear timelines and an appeal process can help businesses understand the steps available when disagreements arise.

Importers should distinguish between the 90-day period for deciding specified disputes and the 30-day deadline for lodging an appeal. These are separate requirements and should not be treated as interchangeable.

Businesses involved in classification cases will need to review the amended order and ensure that their submissions comply with the applicable procedures once the changes take effect.
