Supreme Court reinstates Justice Tariq Mahmood Jahangiri, suspends High Court order

ISLAMABAD: The Supreme Court has suspended the interim order of the Islamabad High Court and allowed Justice Tariq Mahmood Jahangiri to resume judicial work.

The constitutional bench, while hearing the case on Monday, ordered to issue notices to the Attorney General’s Office, petitioner Mian Dawood, Islamabad Bar Council and District Bar Association.

During the hearing, Justice Jamal Khan Mandokhel remarked that the Supreme Court has already ruled that no judge can be stopped from judicial work, the matter is limited only to the interim order of the High Court. He added that a meeting of the Supreme Judicial Council has been called for October 18.

Justice Shahid Bilal observed that there were objections to the writ petition filed in the Islamabad High Court but despite this, it was numbered. He directed the lawyers to appear on this point tomorrow with preparation.

During the hearing, Justice Tariq Mehmood Jahangiri said that he would sit in the bench to hear the cases today itself. On this occasion, lawyer Munir A. Malik took the stand that the order to stop Justice Jahangiri from working was against the requirements of justice and the law was ignored. He said that this is the first time that a two-member bench of the High Court has separated its own judge from judicial work.

Munir A. Malik further said that the writ against Justice Jahangiri was filed on July 10, 2024, but despite the passage of more than a year, the objections of the Registrar’s Office remain. He said that a constitutional petition was also filed against the transfer of judges, which was declared valid, but the appeal is still under hearing.

Later, the Constitutional Bench of Supreme Court adjourned the hearing till tomorrow.
